Eggs USA: Egg Seller Legal Compliance Checklist
To list farm-fresh eggs and receive online payments on Eggs USA, you must certify that you meet all state and local agricultural requirements. Please review and check the following boxes to proceed:
- [ ] Egg Handler Registration: I certify that I am a registered Egg Handler with my state’s Department of Agriculture (or hold the equivalent required state small-producer permit).
- [ ] Grading and Candling: I certify that all eggs sold through this platform have been candled for internal quality and properly graded by size and quality standard.
- [ ] Proper Labeling: I certify that all egg cartons will be properly labeled before pickup with the common name (“Chicken Eggs”), my farm’s name, full physical address, zip code, the quantity (e.g., “One Dozen”), and the packing date.
- [ ] Refrigeration & Cold Chain: I agree to hold, transport, and maintain all shell eggs at a continuous temperature of 45°F or lower right up until the exact moment of buyer pickup.
- [ ] Stripe Connect & 10% Platform Fee: I agree to securely link my bank account via Stripe Connect to receive automated payouts. I acknowledge that Eggs USA automatically deducts a flat 10% platform transaction fee from the gross order amount before processing my payout.
- [ ] Perishable No-Show Acceptance: I understand that due to the perishable nature of raw eggs, if a buyer fails to pick up their order within my designated pickup window, the order will be marked as a “No-Show.” I will still receive my payout (minus the 10% platform fee), and I am authorized to dispose of or resell the uncollected eggs.
••[ ] Compliance Guarantee: I understand that failure to maintain these agricultural or marketplace standards may result in the immediate suspension of my seller account, holding of pending Stripe payouts, and removal of my listings.
⚠️ Important Notice for Egg Buyers
- Online Payment & Local Pickup Only: This item must be paid for online through our secure Stripe checkout and cannot be shipped. You must arrange local, in-person pickup directly with the seller after your payment is processed.
- Perishable Order No-Show Policy: Eggs are fresh, perishable food items. You must pick up your order during the vendor’s specified pickup window. Failure to pick up your order within the designated time frame will result in a forfeited order with no refund. The seller will retain the payment, and uncollected eggs will be disposed of or resold for food safety reasons.
- Bring Order Confirmation: You must present your Eggs USA digital order receipt or confirmation code to the vendor at the time of pickup to verify your order.
- Food Safety Reminder: Keep eggs refrigerated at or below 45°F immediately following pickup. To prevent illness from bacteria, thoroughly cook eggs until yolks are firm.
••Platform Disclaimer: Eggs USA handles financial processing via Stripe but does not inspect or verify the production methods, grading, or storage of these eggs. Buyers assume all responsibility for verifying quality and regulatory compliance with the seller at the time of pickup.
Marketplace Terms of Service: Egg & Agricultural Sales
- Platform and Financial Role: Eggs USA acts solely as an online venue and marketplace connecting local agricultural producers (“Sellers”) with local buyers (“Buyers”). Eggs USA provides online transaction processing services via Stripe Connect to facilitate purchases, but does not produce, inspect, handle, store, or deliver any food products, including raw shell eggs.
- Stripe Connect Payments & 10% Platform Fee: All transactions must be completed securely through the Eggs USA online checkout using Stripe Connect. Off-platform payment arrangements are strictly prohibited. By selling on the platform, Sellers agree to a flat 10% marketplace platform transaction fee, which is automatically deducted from the gross sale amount at the time of purchase before the remaining 90% of funds are distributed to the Seller’s connected Stripe account.
- Perishable “Buyer No-Show” Policy: Because raw shell eggs are highly regulated, perishable agricultural products, Buyers must collect their purchases within the specific date, time, and location window designated by the Seller. If a Buyer fails to collect their order within the specified window without prior written agreement from the Seller, the order will be classified as a “Buyer No-Show.” In the event of a No-Show, the transaction is non-refundable, the Buyer forfeits the items, the Seller retains their portion of the payout (gross sale minus the 10% platform fee), and the Seller may legally dispose of or resell the eggs to protect food safety.
- Tax & Regulatory Responsibility: Sellers are exclusively responsible for calculating, reporting, and remitting any applicable state or local sales taxes on their agricultural goods, as well as maintaining valid Egg Handler Registrations, grading, candling, carton labeling, and strict refrigeration mandates (e.g., maintaining a temperature of 45°F or lower).
- Indemnification & Liability: The Seller agrees to indemnify, defend, and hold harmless Eggs USA from any and all claims, liabilities, food safety enforcement actions, transaction disputes, fines, or health complaints arising from the sale, consumption, or handling of eggs processed through the platform.
